You won at the Consumer Commission but the company has not paid: what now?
If a company does not comply with a Consumer Commission order in the time given, you can ask the same Commission to enforce it (section 71 of the Consumer Protection Act, 2019); not complying is also an offence (section 72).
Winning the order is not the end if the company does not pay. The Act gives the Commission the powers to make it.
Check the order
- What it awarded: refund, interest (rate and from which date), compensation, costs.
- How long the company has to comply (for example “within 45 days”), and from when.
- Any amount the company has already paid.
Apply for execution
After the time to comply has passed, file an execution application in the same Commission: under section 71, an order is enforced like a decree of a civil court; under section 72, not complying is punishable. Set out the order, the date it was due, what is owed today (with interest to date), and ask the Commission to enforce it.
Questions
- What can I do if the company ignores a consumer court order?
- File an execution application in the same Commission under sections 71 and 72 of the Consumer Protection Act, 2019.
