The 2-year limit for consumer complaints in India
A consumer complaint must be filed within 2 years of the date the cause of action arose (section 69 of the Consumer Protection Act, 2019). A later complaint is admitted only if the Commission accepts the reason for the delay.
Missing the limit is the most common way a good consumer case is lost. Here is how it works.
The rule
Section 69(1): a complaint must be filed within 2 years from the date on which the cause of action arose. Section 69(2): a Commission may admit a later complaint if it is satisfied there was sufficient cause for the delay, and it must record its reasons.
When does the clock start?
Usually on the date the problem arose: when the product failed, the service was refused, or the refund became due and was not paid. Where it is unclear, take the earliest reasonable date and file in good time.
Complaining to the company, the helpline or by notice does not by itself stop the clock, so do not let the earlier steps run on close to the limit.
