How to send a legal notice to a company yourself in India
A consumer can send a legal notice without a lawyer: a dated letter to the company’s registered office setting out the facts, what is owed and a deadline, sent by Speed Post with proof of delivery.
A legal notice is the last formal step before the Consumer Commission. The Consumer Protection Act does not require one, but it often brings a settlement, and it shows the Commission you gave the company a fair chance.
What a consumer legal notice says
- Your name and address, and the company’s full legal name and registered office address.
- The facts, with dates: purchase, the problem, your complaints so far (and the helpline docket).
- What the company must do (refund, replacement, compensation) and by when.
- That you will file a complaint before the Consumer Commission under the Consumer Protection Act, 2019 if it does not.
- A list of the documents you rely on, and your signature.
How to send it
- Find the registered office address (on the invoice, the company’s website or its MCA filing).
- Print, sign and keep a copy.
- Send it by Speed Post (or registered post) and keep the receipt.
- Download the delivery report when it arrives; the deadline in the notice is counted from delivery.
Questions
- Do I need a lawyer to send a legal notice?
- No. A consumer can send a notice in their own name. A lawyer’s letterhead is not required.
- How many days should a legal notice give the company?
- There is no fixed period in the Act for a consumer notice; a clear, reasonable deadline is usual. Haq uses 15 days.
How Ambiful Haq helps
Haq writes the notice from your case as a print-ready PDF, with your documents listed, and tracks the deadline from delivery.
